Apple, Cisco Agree to Disagree on iPhone a Little Longer

Apple and Cisco extend time to agree on iPhone trademarkThe saga between Cisco and Apple officially continues a little longer before going to court for the trademark rights of the iPhone. The two companies issued a joint statement late yesterday citing that they have agreed to delay law suit procedures in order to try to come to some consensus outside of the courtroom.

“Apple and Cisco have agreed to extend the time for Apple to respond to the lawsuit to allow for discussions between the companies with the aim of reaching agreement on trademark rights and interoperability.”

Apple and Cisco had been in negotiations for the iPhone trademark up until the day before Apple launched their version of the iPhone. Within a day after Apple’s announcement at the annual MacWorld conference, Cicso sued Apple for trademark infringement on the iPhone name, making it clear that the negotiations the two companies where having before the launch had not gone favorably for Apple. Cisco had also launched a lineup of iPhone products only a month before Apple’s announcement.

It’s difficult to say what prompted this extension in negotiations outside of court. It could be that Apple had decided that the lawsuit was not quite as “silly” as they had stated earlier last month, and that they may be wasting a lot of money, time and publicity by dragging this issue through court.

A SlipperyBrick poll on the iPhone trademark lawsuit which was started on January 12th shows that 50% of the voters think Apple would win if the issue went to court, while 43% voted for Cisco. The other 7% of the votes were for SlipperyBrick (thank you for your support), although we read that to mean ‘undecided’.

    Cisco trademarked the name iPhone back in 1998 … way before Apple came out with the iPod / iTunes ect. Cisco never said they couldn’t use the name, they said they could only use the name if they made the apple iPhone interoperable between the Cisco iPhone … apple new cisco owned the name and i hope they lose

    Apple was dumb to ignore the name rights that Cisco has for “iPhone”. Apple deserves to get there butt kicked. They might consider macPhone and macPhone Pro. If they want to add the “i” to relate the phone to the iPod/iTunes side of Apple then perhaps they can go with “iMacPhone” or “iMP” for short. Apple is beginning to act like Microsoft (big and obnoxious).

    If Microsoft released a new “iPod”, what would happen?
    And normally I’d think “well, Cisco should have know”, way back in 1998, there is no way they could have known.
    Mac, stop trying to be the bully. You aren’t good at it.

    The law is actually a tad fuzzy here and with good reason, just like domain names squatting is frowned on, Cisco has scrambled to make it look like they have been using the name all along but in fact many of the so called iPhone products have shipped with no such name on them, even online shops still show them with no iPhone on the product and one site has a clearly photoshopped image with the i added. thats just laim. if microsoft came out with an iPod they would lose in a heartbeat, its a very well known product and by that name. how bout trademarking every conceivable name for a tourist outfit to fly people to mars? thats not what trademarks are for, its so you can commit massive amounts of marketing dollars and be sure that no one else is going to do the same with the same name, Cisco just sat on it, thats weak and they know it.

    All i know is it was stupid to go through this big oh deal for a damn name. Cisco should have looked at all the i’s in front of apple’s apps and everything. Cisco’s phone don’t even look unique one bit. Looks like a Nokia 5190. Just do a screen adjust ment different color and new face plat and there you go Cisco’s iphone lol
